1. Acceptance of Terms

By accessing or using KhaYin ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please discontinue use of the Service immediately.
We reserve the right to modify these Terms at any time. Continued use of the Service following notice of changes constitutes acceptance of the revised Terms.

You must be at least 13 years old to use KhaYin. If you are under 18, you must have your parent or guardian's consent.
By using KhaYin, you represent and warrant that all information you provide is accurate and that you have the right to enter into these Terms.

You may create an account using your email address and password, or via passkey authentication.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately at support@khayin.org if you suspect unauthorized access to your account.
We reserve the right to terminate accounts that violate these Terms or that have been inactive for more than 24 months.

You agree not to use KhaYin to: transmit illegal, harmful, or offensive content; harass, abuse, or threaten other users; infringe on intellectual property rights; distribute malware or conduct phishing attacks; impersonate other individuals or entities; violate any applicable local, national, or international laws.
You agree not to: attempt to reverse-engineer, decompile, or disassemble any part of the Service; circumvent technical measures protecting the Service; use automated scripts to create accounts or collect data; overload our infrastructure with excessive requests.

As a meeting host, you are responsible for the conduct of participants in your meetings.
You must obtain appropriate consent from participants before enabling cloud recording. By activating the recording feature, you confirm that all participants have been notified and have consented.
Meetings may not be used to facilitate illegal activities, distribute child sexual abuse material, conduct unauthorized surveillance, or violate participants' privacy rights.
We reserve the right to terminate meetings and suspend accounts that violate these rules without prior notice.

Cloud recordings are securely hosted in encrypted cloud storage. You retain ownership of content you record.
By using the recording feature, you grant KhaYin a limited license to store, process, and serve the recording solely for the purpose of making it available to you.
You are solely responsible for ensuring that recordings comply with applicable laws, including consent and data protection requirements in your jurisdiction.
We may delete recordings that are reported to violate these Terms. We do not routinely access or review recordings.

KhaYin and its original content, features, and functionality are owned by KhaYin and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you create or share on the platform, including recordings.
You grant KhaYin a non-exclusive, royalty-free license to use, process, and store your content only as necessary to provide the Service.

KhaYin is currently provided free of charge. We reserve the right to introduce paid tiers or change our pricing model in the future, with advance notice to users.
We aim for high availability but do not guarantee uninterrupted access. The Service is provided "as is" and "as available".
We may perform maintenance, updates, or emergency downtime at any time and will endeavour to minimize disruption.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KHAYIN IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
IN NO EVENT SHALL KHAYIN OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total liability to you for any claims arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim (which may be zero for free-tier users).

You agree to indemnify and hold harmless KhaYin and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

You may terminate your account at any time from the Dashboard settings.
We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms.
Upon termination, your right to use the Service ceases, and we will delete your account data as described in our Privacy Policy.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation.
If a dispute cannot be resolved informally, you and KhaYin agree to submit to binding arbitration, except where prohibited by law.
